Elgin Home Sales on the Kane County and Cook County Sides
Elgin Purchases and Sales on Both Sides of the Kane–Cook Line
Elgin is one of Kane County’s largest cities, built along the Fox River with a downtown anchored by the Gail Borden Public Library, the riverfront and the Grand Victoria Casino. The city also extends east into Cook County, so two Elgin homes a few miles apart can be governed by different county assessors, tax calendars and recording offices. Angelillo Law represents Elgin buyers and sellers from our office at 2325 Dean Street, Ste 800F, St. Charles, IL 60175.
Attorney Joseph S. Angelillo handles attorney review, inspection requests, the City of Elgin transfer stamp application, title and closing, for older homes in Elgin’s historic neighborhoods and for newer subdivisions on the far west side toward Randall Road. This page is general information, not legal advice. For your purchase or sale, call (630) 688-7511.

Kane Side vs. Cook Side
- Recording. Kane-side deeds are recorded through Kane County in Geneva. Cook-side deeds are recorded through the Cook County Clerk’s recordings division.
- County transfer tax. Both counties charge $0.25 per $500, customarily paid by the seller, in addition to the Illinois tax.
- Assessment and tax bills. Cook County reassesses on its own cycle and bills in two installments, with the first installment based on a percentage of the prior year’s taxes. Kane County uses township assessors and its own billing schedule. The tax proration language in the contract should fit the county the home is in.
- Courts. Kane’s Elgin Branch Court at 150 Dexter Court handles traffic, misdemeanor and ordinance matters; Kane probate, chancery and foreclosure cases are heard at the courthouse in Geneva. For the Cook County part of Elgin, many civil matters are heard at the Third Municipal District courthouse in Rolling Meadows, while probate and chancery cases are heard in Cook County’s downtown divisions.

City of Elgin Transfer Stamp Process
Elgin does not charge a per-dollar city transfer tax, but it does require a City transfer stamp before a deed for property inside city limits is recorded. According to title-industry listings:
- The seller submits the City’s transfer form with the PTAX-203 declaration and the deed to the City’s transfer stamp office.
- The City searches for code violations and outstanding debts, and the buyer must acknowledge the results. Request the search three to five days before closing.
- The final water meter reading is taken within five days of closing, and the final water bill and other City debts must be paid.
- Vacant properties may require a City inspection before the stamp issues.
The code-violation search is where Elgin deals most often go sideways: an open permit or a violation notice from years ago can surface days before closing. Sellers who know of open permits should tell us early, and buyers should decide during attorney review how any violation will be handled.
Elgin Neighborhoods and Property Issues
- Historic neighborhoods near downtown: Elgin has locally designated historic districts with design review for exterior work, plus many pre-1978 homes requiring the lead-based paint disclosure.
- Two-flats and small rentals: existing leases, security deposits and any City rental licensing need to be addressed in the contract and at closing.
- Far west-side subdivisions: HOA declarations and, in some areas, special service areas that appear on the tax bill.
- Homes near the Fox River or creeks: confirm the flood zone before the mortgage commitment date.
