Home Seller Attorney in St. Charles & the Fox Valley
Clearing the Path from Listing to Payoff
Representing Fox Valley Home Sellers Through Disclosures, Negotiations and Closing
A seller’s risk is different from a buyer’s. Sellers make written disclosures they can be held to, answer the buyer’s attorney and inspector on a deadline, and must deliver clear title on the closing date. Angelillo Law represents sellers in St. Charles and throughout the Fox Valley, from long-time owners of homes near the river and downtown St. Charles to families selling a west-side subdivision home to move up or downsize. Our office is at 2325 Dean Street, Ste 800F, St. Charles, IL 60175.
Attorney Joseph S. Angelillo prepares the seller’s side of the transaction from listing through payoff and closing. This page is general information, not legal advice. For your sale, call (630) 688-7511.

Before You List
- Disclosures. Most sellers of one-to-four unit homes must complete the Residential Real Property Disclosure Report (765 ILCS 77) and provide the Illinois radon disclosure (420 ILCS 46). Homes built before 1978 also need the federal lead-based paint disclosure. We help you answer accurately; the form asks what you actually know.
- The listing agreement. After the NAR settlement changes, commission terms and any offer of compensation to a buyer’s broker should be clear in writing. We can review the agreement before you sign.
- Paperwork to gather. Permits for past work, the existing plat of survey, your owner’s title policy, HOA contact information and your mortgage and home equity account numbers.

Responding to the Buyer’s Attorney
During attorney review the buyer’s attorney may propose changes to dates, credits, inclusions or financing terms. We advise which requests to accept, counter or reject, and how each change shifts risk to you. The inspection request usually arrives at the same time. A seller can repair, offer a credit, adjust the price or decline, and the choice affects what you must deliver and certify before closing.
Payoffs, Liens and Title Problems
- Mortgage and HELOC payoffs. Home equity lines must be paid and frozen so they cannot be drawn on after closing.
- Old releases and judgments. A mortgage that was paid years ago but never released, or a judgment against someone with the same name, can hold up title. We work with the title company to clear them.
- Estate, trust and divorce sales. If the owner has died, the house may need to be sold by an executor through the Kane County Courthouse in Geneva or by a trustee under the trust. Divorce sales follow the judgment. We confirm who has authority to sign.
What Sellers Pay in Fox Valley Towns
- Illinois and county transfer taxes: $0.50 plus $0.25 per $500 of the price, customarily paid by the seller.
- St. Charles, Geneva and Batavia: no city transfer stamp on title-industry lists, but each city sells electric as well as water, so the seller orders a final City utility bill covering both.
- Aurora: $3.00 per $1,000 city transfer tax, listed as a seller cost, plus the City’s Statement of Open Accounts process.
- Elgin: no per-dollar tax, but a City stamp application, a code-violation search and a final water reading.
- Other closing items: the owner’s title policy is customarily a seller cost in this area, along with the property tax credit to the buyer and the brokerage commission set by your listing agreement.
Selling Without a Listing Agent
For-sale-by-owner sellers in St. Charles and nearby towns still need a written contract, the required disclosures, a title commitment and a closing. We can prepare the contract, coordinate with the buyer’s attorney and lender, and order title. Our Illinois home seller’s guide covers preparation and pricing.
Moving Before or After Closing
Attending closing in person is often optional for sellers. Sellers who have moved away can often sign the deed and closing documents ahead of time by arrangement with us via a properly executed power of attorney. Sellers who need to stay after closing can negotiate a post-closing possession agreement, often with money held in escrow until the keys are delivered.
