Home Purchases & Sales in the Kane County Seat
Geneva Home Sales, from the Third Street District to Randall Road
Geneva is the Kane County seat, so many of the offices that touch a Kane County home sale are in town: the Kane County Government Center on South Batavia Avenue and the historic Kane County Courthouse on South Third Street. Angelillo Law represents buyers and sellers of Geneva houses, townhomes and condominiums from our office just up the Fox River at 2325 Dean Street, Ste 800F, St. Charles, IL 60175.
A Geneva sale might be a nineteenth-century home a few blocks from the Third Street shops, a 1990s subdivision home west of Randall Road, or a townhome near the Metra station. Attorney Joseph S. Angelillo reviews the contract, handles attorney review and the inspection response, and works through title, City of Geneva utility closeouts and the closing. This page is general information, not legal advice. For your Geneva transaction, call (630) 688-7511.

What Is Different About a Geneva Closing
- The City is the electric company. The City of Geneva provides electric service as well as water and sewer to most addresses in town. A seller’s final City bill therefore covers electric usage, not just a water reading. The City’s move-out form asks for the closing date and allows two business days to take a final read.
- Transfer stamps. Title-industry transfer stamp lists do not show a City of Geneva transfer tax. The Illinois ($0.50 per $500) and Kane County ($0.25 per $500) transfer taxes still apply and are customarily paid by the seller. We confirm the City’s current requirement before every Geneva closing.
- County offices on Batavia Avenue. Kane County recording and transfer stamps run through the county offices at 719 S. Batavia Avenue. The title company normally records the deed and mortgage on your behalf.
- The courthouse on Third Street. The Kane County Courthouse at 100 S. Third Street hears civil, chancery, probate and foreclosure cases. When a Geneva house is being sold out of an estate, through a court-approved sale or with a foreclosure case on file, that court’s orders shape who signs and when the deal can close.

Older and Historic Geneva Homes
Central Geneva has one of the Fox Valley’s larger concentrations of nineteenth- and early twentieth-century houses. Homes built before 1978 require the federal lead-based paint disclosure. If the house is in a locally designated historic area, exterior changes such as windows, porches and additions may need City review, so buyers who plan work should ask the City early. During the inspection period we also compare additions, finished basements and detached garages against the permit history, because unpermitted work is easier to address before the buyer is bound.
Geneva Property Types and the Issues They Raise
- Downtown-area and river homes: older systems, narrow lots, shared driveways and detached garages near lot lines. The plat of survey and title commitment show encroachments and easements.
- West-side subdivisions toward Randall Road: homeowner association declarations that control fences, sheds, exterior colors and leasing.
- Townhomes and condominiums: association disclosures under Section 22.1 of the Illinois Condominium Property Act, the budget, reserves and any special assessments.
- Mill Creek and other addresses outside the City: the City of Geneva states that it does not provide utility service in the Mill Creek subdivision, so utilities, permits and fees there may come from other providers or from Kane County. A Geneva mailing address does not by itself mean a home is inside city limits.
- Homes near the Fox River: check the FEMA flood zone early; a lender may require flood insurance, which affects the buyer’s monthly cost.
How We Run a Geneva Transaction
- Send us the signed contract as soon as it is accepted, and we calendar the attorney review and inspection deadlines it sets.
- During attorney review we address possession, the closing date, inclusions and any terms the form leaves open.
- We prepare or answer the inspection request, focusing on repairs versus credits for older-home systems.
- We review title, survey and any association documents, and clear payoffs or old liens with the title company.
- Sellers submit the City of Geneva utility move-out request with the closing date; buyers start service in their name.
- We review the settlement statement against the contract and attend closing. Before wiring funds, verify instructions by phone with the title company.
